The Ministry of Justice has prepared a draft bill which will regulate and formalize the procedures, benefits and penalties of returning funds in cases of fraud and embezzlement. The draft bill, which will be discussed in Parliament on Friday, greatly reduces the existing penalties.
According to the draft bill, if the funds are retuned by the time the defendant states his play, he may incur a three-year prison sentence. If he chooses to return the funds at the first instance trial, the sentence increases to seven years.
While this regulation may encourage some to return embezzled public funds, it will not apply to ministers, general and special secretaries, members of parliament, regional governors or mayors. The Ministry of Justice is, however, trying to include further categories in its regulation by coordinating with other political forces in Parliament.
