The Council of State is considering the request of POSPERT to reinstate the former public broadcasting service ERT. In order to come to a decision, the Council will have to address three issues raised by Konstantinos Kousoulis on behalf of POSPERT:

  • Whether the specific legislation implemented can eliminate a joint stock company
  • Whether the dismissal of ERT’s employees conflicts with the Constitution and the European Convention and
  • Whether the Council of State has the authority to decide on the dismissal of employees.

The State Council president Sotiris Rizos also raised questions as to why ERT’s proposed “permanent replacement” NERIT has not begun broadcasting, rather than the “transitional temporary» DT channel, which was meant to operate for two months/

POSPERT and the Greek State will have until Friday the 4th of October to submit their files on the case, with the crucial decision expected to be announced in a few months.
